Terms of Service

Welcome to NoCoBids. These Terms of Service ("Terms") are a contract between you and NoCoBids ("NoCoBids," "we," "us," or "our") governing your use of our website, directory, and related services (the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy.

1) Who may use the Services

• You must be at least 13 years old.
• If you use the Services on behalf of a business, you represent you have authority to bind that business.
• If you list regulated services (e.g., electrical, plumbing), you are responsible for all required licenses and insurance and for complying with applicable law.

2) What the Services include

• A public directory that displays business/individual name, website, email, and business phone by category and location.
• An authenticated request-for-bids ("RFB") workflow for homeowners/customers and contractors/businesses.
• We may add or change features; material changes will be reflected in these Terms.
• We are not a party to agreements between homeowners and contractors. We do not guarantee pricing, availability, quality, or outcomes.

3) Accounts & security

Some features (e.g., posting jobs, viewing/responding to RFBs) require an account. You're responsible for your account and keeping your credentials secure. Notify us promptly of unauthorized use.

4) Directory listings & accuracy

• The directory shows public and/or owner-submitted business contact info.
• We do not guarantee listings are complete, accurate, or current.
• Owners may claim, correct, or request removal of information we control (see Section 18).
• Any "Verified" indicators mean only that we checked a specific fact at a point in time; they are not endorsements.

5) Request-for-bids (RFB) marketplace

• Homeowners/Customers post structured job requests; businesses may respond with bids.
• Homeowners/Customers are responsible for scope selection and contractor choice.
• Businesses are responsible for their bids, licensing, insurance, and workmanship.
• Communications may occur via the Service; keep all interactions lawful and respectful.
• Taking work off-platform is at your own risk and outside these Terms.

6) Fees & payments (no subscriptions)

A. Homeowners / Customers

One-time Access Fee: $5 to unlock the RFB posting platform for your account. This is a platform access fee, not a deposit or guarantee of responses. Non-refundable except where required by law.

B. Businesses / responders (non-recurring passes)

You can purchase one-time passes to view and submit bids in your selected business areas (categories/locations you choose):

• Trial — $5: up to 3 total bids (no time window unless otherwise stated at checkout).
• Standard — $50: one time fee with up to 3 bids a month starting on the month of purchase
• Unlimited — $100: unlimited bids lifetime

Fair-use & technical limits: "Unlimited" is subject to reasonable, non-abusive use and to system safeguards (e.g., per-day caps, invite limits, rate limits) designed to protect users from spam and maintain platform quality.

C. General payment terms

• Payments are processed by third parties (e.g., Stripe); you agree to their terms.
• Prices may change prospectively; updates will be posted before taking effect.
• Except where required by law, fees are non-refundable. If we later identify a posting as spam/duplicate or a systemic issue prevented reasonable use, we may issue good-will credits or refunds at our discretion.

7) Acceptable use & abuse policy (our right to suspend)

You agree not to:

• Break the law, infringe rights, or submit false, deceptive, or harmful content.
• Spam, mass-bid off-topic jobs, or attempt to game exposure/invites.
• Harass, threaten, or abuse other users, or share another person's private info without consent.
• Scrape, harvest, or bulk-export data; bypass rate limits; probe or overload our systems; upload malware.

Enforcement: We may suspend or terminate accounts, remove content, revoke access passes, and/or restrict features with or without prior notice for violations or suspected abuse. No refunds are due for suspensions arising from your violations.

8) Your content & license to us

If you submit content (business info, job details, messages), you grant NoCoBids a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate the Services. You represent you have the necessary rights. You retain ownership.

9) Our content & IP

The Services (text, design, logos, software) are owned by or licensed to NoCoBids and protected by law. Except for rights expressly granted, no license is granted. Do not reuse our brand, designs, or code without permission.

See our Privacy Policy for how we collect and use information.

11) Third-party services & links

The Services may link to third-party sites or integrate third-party providers (hosting, payments, email/SMS). We are not responsible for third-party websites or policies.

12) Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE." We make no warranties about accuracy, availability, merchantability, fitness, or non-infringement. We don't guarantee that a job will receive bids or that any bid will be accepted or completed.

13) Limitation of liability

To the fullest extent allowed by law, NoCoBids and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any amount exceeding the greater of $100 or the amount you paid to us in the 12 months before the claim. Nothing here limits liability where prohibited by law.

14) Indemnification

You agree to defend, indemnify, and hold harmless NoCoBids from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, your violations of these Terms, or your interactions with other users.

15) Termination

You may stop using the Services at any time. We may suspend or terminate your access (and remove content) if we believe you violated these Terms or pose a risk to others or to the Service. Sections that by their nature should survive (IP, disclaimers, limits, indemnity) survive termination.

16) Changes to the Services or Terms

We may modify the Services and these Terms from time to time. If we make material changes, we'll update the Effective date and may provide additional notice. Continued use after changes means you accept the updated Terms.

17) Governing law & venue

These Terms are governed by the laws of the State of Colorado, without regard to conflicts principles. You agree to exclusive jurisdiction and venue in the state or federal courts of Larimer County, Colorado for disputes not subject to small-claims.

19) DMCA / IP complaints

Send copyright notices to [DMCA contact email] with: (a) your contact info, (b) identification of the copyrighted work and the allegedly infringing material, (c) a good-faith statement, and (d) your signature.

20) Entire agreement

These Terms, plus the Privacy Policy and any feature-specific terms, are the entire agreement between you and NoCoBids regarding the Services.
